The Punjab School Education Board (Amendment) Act, 2016

AN
ACT

further to amend the Punjab School Education Board Act, 1969. BE it enacted by the Legislature of the State of Punjab in the Sixtyseventh Year of the Republic of India as follows :-

1. Short title and commencement:-

(1) This Act may be called the Punjab School Education Board (Amendment) Act, 2016.

(2) It shall come into force on and with effect from the date of its publication in the Official Gazette.

2. Amendment in section 2 of Punjab Act 24 of 1969:-

In the Punjab School Education Board Act, 1969 (hereinafter referred to as the principal Act), in section 2, after clause (j), the following clause shall be inserted, namely :- “(jj) “Senior Vice-Chairman” means the Senior Vice-Chairman of the Board;”.

3. Amendment in section 4 of Punjab Act 24 of 1969:-

In the principal Act, in section 4,-

(a) in sub-section (1), for the words and sign “Chairman, ViceChairman”, the words and signs “Chairman, Senior Vice-Chairman, Vice-Chairman” shall be substituted; and

(b) in sub-section (2) for the words “The Chairman and the ViceChairman”, the words and sign “The Chairman, the Senior ViceChairman and the Vice-Chairman” shall be substituted; and

(c) in sub-section (4), for the words “the Chairman and ViceChairman”, the words and sign “the Chairman, the Senior ViceChairman and Vice-Chairman” shall be substituted.

4. Amendment in section 5 of Punjab Act 24 of 1969:-

In the principal Act, in section 5,-

(a)

In the margin, for the words and sign “Chairman, ViceChairman”, the words and signs “Chairman, Senior ViceChairman,Vice-Chairman” shall be substituted;
In sub-section (1), for the words “Chairman and ViceChairman”, the words and sign “Chairman, Senior ViceChairman and Vice Chairman” shall be substituted; and
In the second proviso to sub-section (1), for the words “Chairman or Vice-Chairman”, the words “Chairman or Senior Vice-Chairman or Vice-Chairman” shall be substituted; and

(b) in sub-section (3), for the words “Chairman or Vice-Chairman”, the words “Chairman or Senior Vice-Chairman or Vice- Chairman” shall be substituted.

5. Amendment in section 6 of Punjab Act 24 of 1969:-

In the principal Act, in section 6,-

(a) in the margin, for the words “Chairman and Vice-Chairman”, the words and sign “Chairman, Senior Vice-Chairman and ViceChairman” shall be substituted;

(b) for the words “Chairman or Vice-Chairman” wherever occurring, the words “Chairman or Senior Vice-Chairman or Vice-Chairman” shall be substituted; and

“(a) he has served the Central Government or State Government or both as Member of the Indian Administrative Services or Punjab Civil Services for a period of not less than ten years;”

6. Amendment in sections 10 and 10-A of Punjab Act 24 of 1969:-

In the principal Act, in sections 10 and 10-A, for the words “Chairman and Vice-Chairman” wherever occurring, the words and sign “Chairman, Senior Vice-Chairman and Vice-Chairman” shall be substituted.

7. Amendment in section 12 of Punjab Act 24 of 1969:-

In the principal Act, in section 12,-

(i) in sub-section (1), for the words “Chairman or in his absence the Vice-Chairman”, the words and signs “Chairman, and in his absence, the Senior Vice-Chairman, and in his absence, the Vice-Chairman” shall be substituted;

(ii) in sub-section (2), for the words “Chairman, and in his absence the Vice-Chairman,” the words and signs “Chairman, and in his absence, the Senior Vice-Chairman, and in his absence, the Vice-Chairman,” shall be substituted; and

(iii) in sub-section (3), in the proviso, for the words and sign “Chairman, or the Vice-Chairman”, the words and sign “Chairman, the Senior Vice-Chairman or the Vice-Chairman, as the case may be,” shall be substituted.

8. Amendment in section 13 of Punjab Act 24 of 1969:-

In the principal Act, in section 13, after clause (a), the following clause shall be inserted, namely:-

“(aa) the Senior Vice-Chairman;”.

9. Amendment in section 14 of principal Act 24 of 1969:-

In the principal Act, in section 14,-

(a) in the margin, for the words “Chairman and Vice-Chairman”, the words and sign “Chairman, Senior Vice-Chairman and Vice-Chairman” shall be substituted; and

(b) for sub-section (4), the following sub-section shall be substituted, namely:-

“(4) The Senior Vice-Chairman and Vice-Chairman shall assist the Chairman in all matters, administrative and academic, shall discharge such duties and exercise such powers as may be delegated to them by the Chairman, and shall in the latter’s absence, the Senior ViceChairman, and in his absence, the Vice-Chairman, exercise the powers of the Chairman.”.

10. Amendment in section 18 of Punjab Act 24 of 1969:-

In the principal Act, in section 18, in sub-section (1),-

(a) in clause (a), after sub-clause (i), the following sub-clause shall be inserted, namely :-

“(i-a) the Senior Vice-Chairman;”;

(b) in clause (b), after sub-clause (i), the following sub-clause shall be inserted, namely :-

“(i-a) the Senior Vice-Chairman;”; and

“(i-a) the Senior Vice-Chairman;”.

11. Amendment in section 21 of Punjab Act 24 of 1969:-

In the principal Act, in section 21, in sub-section (3), in clause (a), for the words “Chairman and the Vice-Chairman”, the words and sign “Chairman, the Senior Vice-Chairman and the Vice-Chairman” shall be substituted.
