The following draft of rules further to amend the Punjab Reservation for the Offices of Sarpanches of Gram Panchayats and Chairmen and Vice-Chairmen of Panchayat Samitis and Zila Parishads Rules, 1994, which the Governor of Punjab proposes to make in exercise of the powers conferred by section 227 read with section 12, section 107 and section 170 of the Punjab Panchayati Raj Act, 1994 (Punjab Act 9 of 1994) and all other powers enabling him in this behalf, is published as required by sub-section (1) of the said section 227 for the information of the persons likely to be affected thereby.
Notice is hereby given that the draft will be taken into consideration by the Government on or after the expiry of a period of seven days from the date of publication of this notification in the Official Gazette, together with any objection or suggestion, which may be received by the Director, Rural Development and Panchayats, Punjab, Vikas Bhawan, Sector-62, S.A.S. Nagar (Mohali), from any person before the expiry of the period so specified, with respect to the said draft, namely:-
DRAFT RULES
1.
(1) These rules may be called the Punjab Reservation for the Offices of Sarpanches of Gram Panchayats and Chairmen and Vice-Chairmen of Panchayat Samitis and Zila Parishads (Amendment) Rules, 2018.
(2) They shall come into force on and with effect from the date of their publication in the Official Gazette.

In the Punjab Reservation for the Offices of Sarpanches of Gram Panchayats and Chairmen and Vice-Chairmen of Panchayat Samitis and Zila Parishads Rules, 1994 (hereinafter referred to as the said rules), for rule 6, the following rule shall be substituted, namely;-
Section 107 and 170
“6. On or after the commencement of the Punjab Panchayati Raj Section 107 and (Amendment) Act, 2017 (Punjab Act 12 of 2017), the first reservation 170 for the offices of Chairmen and Vice-Chairmen of the Zila Parishads and Panchayat Samitis shall be made in accordance with the provisions of rule 4 and rule 5. In the subsequent elections, all newly created constituencies shall be bunched together at the end of unreserved constituencies of last roster. In accordance with the principle of rotation, reservation in the subsequent elections shall start from first non-reserved constituency in this roster in the order of Scheduled Caste – Scheduled Caste Women – Women. The remaining constituencies shall be unreserved.”
3. In the said rules, for rule 6 A, the following rule shall be substituted, namely:-
Section 12.
“6A.- On or after the commencement of the Punjab Panchayati Raj (Amendment) Act, 2017 (Punjab Act 12 of 2017), the first reservation for the offices of Sarpanches of Gram Panchayats shall be made in accordance with the provisions of rule 3 and rule 5. In the subsequent elections, all newly created Gram Panchayats shall be bunched together at the end of unreserved constituencies of last roster. In accordance with the principle of rotation, reservation in the subsequent elections shall start from first non-reserved constituency in this roster in the order of Schedule Caste – Scheduled Caste Women – Women. The remaining constituencies shall be unreserved.”
