The Maharaja Ranjit Singh Punjab Technical University (Amendment) Ordinance, 2017

AN
ORDINANCE

further to amend the Maharaja Ranjit Singh Punjab Technical University Act, 2014.

Promulgated by the Governor of Punjab in the Sixty-eighth Year of the Republic of India.

Whereas the Legislative Assembly of the State of Punjab is not in session and the Governor is satisfied that circumstances exist, which render it necessary for him to take immediate action;

Now, therefore, in exercise of the powers conferred by clause (1) of article 213 of the Constitution of lndia, the Governor of Punjab is pleased to promulgate the following Ordinance, namely:-

1. Short title and commencement:

(1) This Ordinance may be called the Maharaja Ranjit Singh Punjab Technical University (Amendment) Ordinance, 2017.

(2) It shall come into force on and with effect from the date of its publication in the Official Gazette.

2. Amendment in section 13 of Punjab Act 5 of 2015:

In the Maharaja Ranjit Singh Punjab Technical University Act, 2014, in section 13, for sub-section (2), the following sub-section shall be substituted, namely:-

“(2) (a) The Chairman shall be appointed by the Chancellor out of a panel of persons of national eminence, in the field of Industry, Technology or Technical Education, prepared through a transparent screening process on the advice of the State Government.

(b) When the post of Chairman falls vacant, the Vice-Chairman shall act as Chairman till a new Chairman is appointed.

(c) The Chairman may be removed from the office by the State Government, if,-

(i) he willfully refuses to carry out the provisions of this Act; or

(ii) he abuses the powers vested in him; or

(iii) he is adjudged as an insolvent; or

(iv) he is convicted by a court of law for an offence involving moral turpitude; or

(v) it appears to the State Government that his continuation in office is detrimental to public interest:

Provided that no order of removal under this sub-section shall be passed without giving him a reasonable opportunity of being heard and after recording reasons therefor.”.
